Attack of the Telemarketers

Americans are under siege from telemarketers. It seems that not a day goes by when most Americans do not receive at least one or two telemarketing phone calls. There are no hard numbers about how many telemarketers actually do business within the United States. There are numbers on many of the larger call centers, and even some of the smaller ones; however the main problem is that telemarketing is such a volatile industry that there are so many fly-by-night operations it becomes impossible to track all of them. Therefore the easy answer to how many telemarketers are there is simply too many to track.

Fortunately the winds are changing and telemarketing is starting to become a highly regulated industry with many potential penalties for abuse of the system. Individual states are adopting stringent do not call lists that all telemarketers operating within the state must follow. The state do not call lists are also further enhanced by the fact that telemarketing operations in different states must also follow the do not call list guidelines in whatever state they happen to be calling. Therefore someone in New Jersey who has signed up for the New Jersey do not call list has every reasonable expectation to believe that a telemarketer will not call them no matter where the telemarketer happens to be operating from.

Consumers gained further protection in 2003 when a national do not call registry was put into effect. Unfortunately however and there are many exceptions to the national do not call list as well as a very easy workaround for well-financed corporations. International callers are not regulated by the national do not call list and therefore a company merely has to outsource their call center operations to another country and can continue their telemarketing operations without incident. Additionally the do not call list does not apply to charities, political organizations, surveys, bill collectors, or businesses with which the consumer has an existing business relationship. Companies have found other nefarious workarounds for the national do not call list by including sales pitches in \"survey\" calls.

It is easy to be discouraged by the seemingly incessant torrent of telemarketers however consumers should take heart that at least now there are basic levels of protection with national and statewide do not call lists. Although there are many loopholes and workarounds that companies can use to avoid being targeted by these lists, the do not call lists have still been seen as somewhat of a success due to the fact that they deter all but the most motivated telemarketers. For consumers with a truly bad telemarketing problem it is possible to purchase small electronic devices that they can place on their phone lines that will stop the majority of telemarketing calls. Although this is not an ideal solution, and in a perfect world consumers should not have to buy additional pieces of technology to stop people from calling them it is a small workaround that should be given due consideration especially if you have a terrible telemarketing problem.
